BIRA 99 — Reference to Industrial Court for declaration whether strike, [lock-out, closure or stoppage] is illegal

Statutory text

(1) The [State] Government may make a reference to the Industrial Court for a declaration whether any proposed [strike, lock-out, closure or stoppage will be illegal].

(2) No declaration shall be made under this section save in open Court. [ (3) The declaration made under sub-section (1) shall be recognised as binding and shall be followed in all proceedings under this Act.]
