Gujarat Agricultural Lands Ceiling Act, 1960
(1) Where any land has been declared to be surplus land under any of the provisions of this Act, the State Government shall be deemed to have assumed the management of such land for a public purpose from the date of the declaration. (2) In this section "public purpose" includes settlement of landless cultivators' development of co-operative organisations and increasing the efficiency of cultivation and management. (3) The amount of compensation payable for the assumption of management of a surplus land shall consist of a recurring payment of a sum equal to the reasonable rent to be determined in accordance with the provisions of section 12 and of a further sum equal to one-half of such reasonable rent to compensate the holder of surplus land for all or any of the following matters, namely:— (i) pecuniary loss due to assumption of management: (ii) expenses on account of vacating the land, the management of which has been assumed; (iii) expenses on account of reoccupy- ing the land on the termination of the management; (iv) damage, if any, caused to the land during the period of management including the expenses that may have to be incurred for restoring the land to the condition in which it was at the time of the assumption of management: Provided that where such surplus land was held by the holder as a tenant, one-third of the compensation shall be paid to such holder and the balance shall be paid to the person from whom the land was held as tenant by such holder.
