Gujarat Agricultural Lands Ceiling Act, 1960
Where after the appointed day, on account of gift, purchase, assignment, lease, surrender or any other kind of transfer inter vires or by succession or parti-tion, any land comes into the possession of any person, or any land held by any person ceases to be exempted land "[ ] and in consequence thereof the total land held by such person exceeds the area which he is entitled to hold under section 6, then— (i) if the acquisition of such excess land was otherwise than by succession or partition it shall be invalid and the excess land shall be forfeited to the State Government, and (ii) if the acquisition was by succession or partition or the excess was due to the land ceasing to be exempted land the excess land shall be deemed to be surplus land held by such person.
