The law relating to the execution of decrees is to be found in sections 36 to 67, 73, 74 and 135 and Order XXI of the Code. The Code imposes on the Judge considerable responsibilities in execution matters. The work of execution is carried out by the Court through its agents. It is essential, according to the scheme of the Code, that the Court should know fully and precisely how far its decrees are satisfied. The Court has the responsibility of preventing the sale of property in which the judgment-debtor does not prima facie appear to have an interest; of seeing that property of a value far in excess of the amount of debt is not sold; of seeing that a reasonable price is realised; and of ensuring that intending purchasers shall have the opportunity of knowing all that it is material for them to know concerning the property. As the sale is held by the Court, it must be conducted in a way just to all parties concerned.
