(i) Rule 1 of Order XXI requires that when money payable under a decree is paid into Court, notice of such payment shall be given to the decree-holder either by the judgment-debtor or at his instance by the Court. Such notice issued by the Court may be in Appendix 3 of Appendix H, Schedule 1 of the Code. The Court should also take such steps as it conveniently can, to prevent moneys due to decree-holders from remaining unpaid and lying with the Court or in the Government Treasury. (ii) Where money due under a decree is remitted to Court by the judgment-debtor by money-order or through a Bank or by other recognised mode and the judgment-debtor or his lawyer is not available to pay the process fees for the notice required to be issued under rule 1 (2) of Order XXI, the notice may be issued initially at Court's costs, but the process fees should subsequently be recovered from the judgment-debtor.
