In the case of a sale of immoveable property, the sale has to be confirmed by the Court (Order XXI, rule 92). Certain cases are stated in Order XXI, rules 89, 90 and 91, in which the sale may be set aside. There are also other reasons, for example, fraud, on account of which a sale may be set aside. A sale should not be set aside without notice to the persons interested (See Forms 36 and 37 of Appendix E) and due enquiry.
