Gujarat High Court Civil Manual (subordinate court practice), 1960
(1) There shall be two examinations called respectively the "Lower Standard" and the "Higher Standard". (2) No candidate selected for appointment to a clerical post in accordance with Government Circular Home Department, No. 3977/3-II, dated the 16th March 1939, shall be confirmed in his appointment as a Clerk unless he has passed the "Lower Standard" Examination. Note.—The above shall not apply to candidates who were selected before 16th March 1939. (3) No clerk shall be promoted to an appointment carrying a salary of more than Rs. 80 in the old scale or of Rs. 100 in the revised scale, unless he passes the "Higher Standard" Examination. Note (i).—The above shall not apply to persons who have either been exempted from passing or passed the Departmental Examination under the rules for such examination previously in force. The promotion of a clerk who has been exempted shall require the special sanction of the District Judge and shall only be made on the ground of the clerk's special efficiency. Note (ii).—Clerks selected before 16th March 1939 who have not passed the Departmental Examination under the rules previously in force shall be required to pass in the two papers prescribed in part A of the Lower Standard Examination, before they appear for the Higher Standard Examination. A District Judge may in his discretion exempt any regular Stenographer from appearing for the Departmental Examination. (4) No clerk shall be permitted to appear for the "Higher Standard" Examination until he has completed 7 years of service as a clerk. It shall, however, be in the discretion of the District Judge to permit, for special reasons to be recorded in writing, any graduate clerk to appear for the said examination on completion of 5 years of service. (5) No candidate or clerk shall be allowed to appear for either examination more than three times, unless the Honourable the Chief Justice for exceptional reasons allows a fourth chance. (6) The examinations shall be in English and shall consist of written papers and oral and practical tests. (7) The examinations shall be held each year in July on the first Monday and Tuesday. (8) At least three months' notice of the exact dates fixed for holding the examination shall be given by the High Court by publication in the Bombay Government Gazette. (9) The Examination Committee in each District shall consist of the District Judge, the Civil Judge (Senior Division), and a third officer who should be an Assistant Judge, a Judge of the Small Cause Court or a Civil Judge as the District Judge may think fit to appoint. The adjudication on the answers shall rest entirely with the Committee. (10) The question papers for the whole of the State shall be drawn by the District Judges selected for the purpose in turn by the High Court. The High Court shall on 1st May of each year remind the District Judges whose turn it is to draw up the question papers and such District Judges shall send the question papers confidentially to the Registrar, High Court, so as to reach him not later than 1st of June. The Registrar shall arrange to have the question papers printed and forward their copies in time to all District Judges in accordance with their respective requirements which should be communicated to the Registrar by the 1st of June at the latest. (11) The number of questions which a candidate is required to answer in each paper shall be limited to ten and the time allowed shall be three hours. (12) The syllabus for the Examinations and the marks for each paper and for the practical and oral tests shall be as under :— Lower Standard. A. Written— (i) Questions to test the examinee's knowledge of such parts of the Code of Civil Procedure as refer to matters coming within the scope of a clerk's duties (with books) 200 (ii) Questions to test the examinee's knowledge of (a) the Limitation Act, the Stamp Act and the Bombay Court-fees Act and (b) Government Notifications on the latter two Acts and (c) the Civil Manual (with books) 200 (iii) Questions to test the examinee's knowledge of (1) The Criminal Procedure Code and (2) The Criminal Manual (with books) 200 B. Practical— A test in typewriting 50 Higher Standard. A Written— (i) Bombay Civil Services Rules Manual, Chapters I to V, XII (Parts III to VIII relating to travelling allowance only) XV and XVII of Vol. I and Appendix XLIV-A of Vol. II (with books) 200 (ii) Civil Account Code, Vol. I, Chapters 3, 4, 5 together with section VI of Chapter 2, Chapters 4, 5, 7 and 14 of the Financial Rules under Devolution Rule 37 (e) (with books) 200
