(i) A suit decided on the defendant's admission is deemed to be decided on the merits, within the meaning of rule 1 (a) of Schedule III of the abovementioned Act and pleader's fee should be allowed in full. (ii) An award filed without contest under section 14 of the Indian Arbitration Act X of 1940, shall not be considered as a suit decided on the merits within the meaning of the rule referred to above.
