Civil Manual 7 — Section

Gujarat High Court Civil Manual (subordinate court practice), 1960

Statutory text

The final outcome of a suit is a decree, and the decree usually requires one party to pay money to, or do or refrain from doing something for the benefit of, the other party. Execution is the expression used to mean the enforcement of the decree. The Code intends that it should be enforced and the Courts are required to give assistance in the enforcement. Moreover execution is a part of the Court's duty requiring care and attention at the hands of the Judge in exactly the same manner as the disposal of suits. But the Court does not, of itself, enforce a decree; it does nothing after making the decree until asked to do so by a party entitled to some benefit under the decree.
