Should include suits abated. Column 5.—Cases received in a manner not specially provided for by any column of the Statement may be included in this column. Column 6.—That is, the total of the entries in columns 21A and 22. Column 7.—Should include suits dismissed for default. Column 7A.—Should include suits abated. Columns 8, 10, 12, 14, 17, 19, 21.—As regards the claculation of duration of cases, the time that the suit has actually been pending in a particular Court should alone be calculated. A case should be considered to abate pending when it is received in the Court whether by institution or by transfer, and to cease pending when it is no longer before the Court, whether as a result of disposal or of transfer to another Court. In the calculation intervals during which a case is in abeyance by reason of an application for review or of a remand should be excluded. The remarks column is intended for use in cases where the Court feels that the application of these instructions does injustice to its work. Gazetted holidays, Sundays and vacations should be included in the calculations, but where a long series of holidays or a vacation is a serious factor in delay this should be noted in the remarks column. The average duration of cases is calculated by dividing the total number of days during which all cases are pending before the Court by the total number of cases. Column 24.—Information regarding the number of cases of Contempt of Court under Chapter XXXV of the Code of Criminal Procedure disposed of by Civil Courts should be shown in the column of remarks. General 1.—Cases under Order XXI, rule 58, Civil Procedure Code, should be treated as Miscellaneous Judicial Cases.
