(1) It shall be lawful for the '[ '[State] Government], in making any rule under section 214, to prescribe that any person committing a breach of the same shall on conviction by a Magistrate be punished with imprisonment for a term not exceeding one month or with fine not exceeding five hundred rupees, or with both, in addition to any other consequences that would ensue from such breach. (2) (a) Nothing in section 214 shall authorise the State Government to make retrospectively a rule prescribing a penalty referred to in sub-section (1). (b) Notwithstanding the retrospective operation of any rule made under section 214, nothing or no action constituting breach of such rule, done or taken by a person before such rule is so made shall render such persons liable to penalty prescribed under sub-section (1).]
