GMA 188 — Timber not to be deposited or hole made in street without permission

Statutory text

(1) No person shall, without the written permission of the chief officer and except in accordance with the conditions of such permission and on payment of such fees as may be specified by the bye-laws of the municipality, make a hole in any street or deposit on any street any timber, stone, brick, earth or other material that has been or is intended to be used for building; such permission shall be terminable at the discretion of the chief officer; and when suchpermission is granted to any person, he shall; at his own expense, cause such materials or such hole to be sufficiently fenced and enclosed to the satisfaction of the chief officer until the materials are removed, or the hole is filled up or otherwise made secure and shall cause such materials or hole to be sufficiently lighted during the night.

(2) Whoever contravenes any of the provisions of sub-section (1) shall be punished with fine which may extend to one hundred rupees, and with further fine which may extend to twenty rupees for every day or night, as the case may be, on which such contravention continues, after the date of the first conviction for such offence.
