If no person [appears within the period specified in the proclamation under sub-section (1) of section 85 and establishes his claim to the property within the period specified in the said sub-section (1)] it shall be at the disposal of the State Government, and property, or such part thereof as has not alreday been sold under sub-section (2) of section 85, may be sold by auction under the orders of the Commissioner, or the Magistrate concerned, as the case may be.
