Complaints are sometimes made that accused persons in police custody are not accorded necessary facilities to interview their relatives and legal advisers. Article 22 (1) of the Constitution provides that no person, who is arrested or who is in custody, shall be denied the right to be defended by a Legal Practitioner of his choice. An accused person, who is remanded into Police custody, has a right to claim a reasonable opportunity of getting into communication with his legal adviser for the purpose of preparing his defence, and the police cannot legitimately claim that in no circumstances should he be allowed to see his legal adviser until they choose to permit it.
