Under section 6 of the Act, the Court may, instead of passing a sentence of imprisonment, pass an order for the offender's detention in the Borstal School for such term not being less than three years and not more than five years as the Court think fit. If, therefore, the court decides to pass an order of detention, a sentence of imprisonment should not be passed.
