Accused person willing to make a confession or a person willing to make statement under section 164, Code of Criminal Procedure, 1973, should be taken for the purpose before the Chief Metropolitan Magistrate, Chief Judicial Magistrate or the Judicial Magistrate, as the case may be, and as far as possible, before the Magistrate who will not eventually try the case. The Chief Metropolitan Magistrate or the Chief Judicial Magistrate may record the confession or statement, himself or would assign for the purpose a Metropolitan Magistrate or Judicial Magistrate at district head quarters, as the case may be, who would not eventually try the case.
