Statutory text

When two or more persons are accused of the same offence or of offences arising out of the same transaction, the Magistrate should not convict some and commit others to the Court of Session. If any one of the accused is charged with an offence beyond the jurisdiction of the Magistrate, or with one which, in the opinion of the Magistrate, ought to be tried by the Court of Session, all the accused persons implicated, against whom there is prima facie evidence, should be committed for trial.
