Statutory text

(1) Under the second proviso to sub-section (2) of Section 309, no adjournment shall be granted when witnesses are in attendance, without examining them except for special reasons to be recorded in writing. So far as possible, all witnesses who are present on any day, should be examined.

(2) The reasons for not hearing a part-heard case, and the adjournment of any case where the witnesses are in attendance, should be recorded by the Magistrate (3) No case should be adjourned on the ground that all the witnesses, who have been summoned, are not present.
