Cases should not ordinarily be adjourned for the personal convenience of the Assistant Public Prosecutor. Frequent absence of the Assistant Public Prosecutor should be reported by the Magistrate to the Chief Judicial Magistrate or the Chief Metropolitan Magistrate, as the case may be. The Chief Metropolitan Magistrate shall communicate it to the Commissioner of Police. Ordinarily, when an Assistant Public Prosecutor consents to be present on a particular date, the magistrate should not adjourn the case, unless the absence of the Assistant Public Prosecutor is due to reasons beyond his control or unless the Magistrate otherwise deems it proper to do so in the interest of justice.
