In view of the provisions of proviso to Section 256 and of section 317 Code of Criminal Procedure, 1973, the mere absence of either the complainant or the accused is not a sufficient cause for adjournment. The Magistrate should, when ever possible, proceed with the hearing of the case in their absence.
