Punjab Pre-emption Act, 1913
If in case of a foreclosure the parties are not agreed as to the amount at which the pre-emptor shallexercise his right of pe-emption, the Court shall determine whether the amount claimed by the mortgagee is due under the terms of the mortagagz, and whether it is claimed in good faith. If it finds that the amount is so due and is claimed in good faith, it shall fix such amount as the price for the purposes of the suit ; but if it finds that the amount is not so due, or, though due, is not claimed in good faith, it shall fix as the price for the purposes of the suit the market value ofthe property.
